Certification of Consistency with the Delta Plan: Delta Conveyance Project
The Delta Conveyance Project is a proposed project of the California Department of Water Resources (Department) that consists of constructing, operating, and maintaining new State Water Project water diversion and conveyance facilities in the Delta. Information about the project is available to the public on the websites of the Department of Water Resources and the Delta Conveyance Design and Construction Authority.
Because the Delta Conveyance Project is a covered action as defined in the California Water Code, the Department is required to prepare a written certification of consistency with detailed findings as to whether the covered action is consistent with the Delta Plan regulations and submit that certification to the Delta Stewardship Council (Council). (Wat. Code, § 85225.) On October 14, 2025, the Department submitted a certification of consistency for the Delta Conveyance Project. Any person who claims that the proposed covered action is inconsistent with the Delta Plan may file an appeal no later than 30 days after submitting the certification of consistency. (Wat. Code, § 85225.10.) The requirements for an appeal are described in the Council’s Appeals Procedures.
The Council does not approve or reject covered actions. The Council has appellate authority and oversight over covered actions. The Council’s appellate review is limited to the record and the issues presented on appeal. After a hearing on the appealed action, the Council will make specific written findings based on the substantial evidence standard.
